1. The Stowd Platform
Stowd is an online marketplace that connects renters looking for storage space with storage facility operators across Canada. Stowd Technologies Inc. ("Stowd", "we", "our") operates the platform accessible at stowd.ca.
Important — Stowd is not a storage provider
Stowd is a marketplace, not a storage provider. We do not own, operate, or manage any storage facilities. Rental agreements are formed directly between the renter and the facility operator. Stowd facilitates the connection and processes payments.
2. Eligibility
To use the Stowd platform, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding contract.
- Not have been previously suspended or banned from the platform.
- Provide truthful and accurate information when registering.
Facility operators must also hold all permits and licences required by applicable law to operate a storage facility.
3. User Accounts
An account is required to make or manage bookings. You are responsible for maintaining the confidentiality of your credentials and all activities that occur under your account. You must notify us immediately of any unauthorized use at info@stowd.ca.
Stowd reserves the right to suspend or terminate an account for breach of these terms, fraudulent behaviour, or activity harmful to the platform or its users.
4. Renters
As a renter, you agree to:
- Only use the rented storage unit for purposes agreed upon with the operator.
- Not store any prohibited items (see section 8).
- Respect the facility's rules and access hours.
- Pay monthly charges on time through the Stowd platform.
- Leave the unit in the condition in which you received it.
- Immediately report any damage or issues to the operator.
The renter is responsible for any damage to the unit or facility beyond normal wear and tear. Stowd assumes no liability for loss, theft, or damage to stored goods.
5. Facility Operators
As a facility operator, you agree to:
- Provide accurate and up-to-date information about your facility, units, and pricing.
- Respond to booking requests within 24 hours.
- Maintain the facility and units in a safe condition consistent with advertised standards.
- Connect a valid Stripe account to receive payments.
- Comply with all laws and regulations applicable to operating a storage facility.
- Not contact renters for commercial purposes outside the platform.
Stowd reserves the right to remove or suspend a facility listing for repeated complaints, non-compliance with these terms, or fraudulent activity.
6. Fees and Payments
Stowd is committed to transparent pricing. Here is how fees work:
Service fee for renters — 3%
A 3% service fee is added to the facility's listed price on each monthly payment. This fee covers secure payment processing and platform maintenance. It is always displayed separately before you confirm your booking.
Example: for a unit listed at $200/mo, you pay $206/mo ($200 unit rent + $6 service fee).
Commission for operators — 8%
Facility operators pay Stowd a monthly commission of 8% on each active rental generated through the platform. There are no listing fees or upfront costs. The commission is deducted automatically from each monthly payment. The operator receives 92% of their listed price.
Full example: listed rent $200/mo → renter pays $206 → facility receives $184 (92% of $200) → Stowd earns $22 ($16 commission + $6 service fee).
All payments are processed securely by Stripe. By making a payment, you also agree to Stripe's Terms of Service.
7. Booking Process and Cancellations
Booking process
A booking request does not constitute a rental agreement. The agreement takes effect only when the operator confirms the request and the renter completes the first month's payment. Unpaid bookings within a reasonable period after confirmation may be cancelled by the operator.
Renter cancellations
- Before confirmation: free cancellation at any time.
- Within 48 hours of first month payment: full refund, including service fee.
- After 48 hours: 30-day notice is required. No refund is given for the current month.
Operator-initiated termination
An operator wishing to end a rental must give the renter 30 days' notice through the platform. In cases of serious breach of these terms by the renter (prohibited items, intentional damage, persistent non-payment), the operator may terminate immediately by notifying Stowd.
8. Prohibited Items
The following items are strictly prohibited from being stored in any unit booked through Stowd. This list is non-exhaustive:
Storing prohibited items may result in immediate termination of the rental, seizure of goods by competent authorities, and legal proceedings. Stowd will fully cooperate with authorities in such cases.
9. Prohibited Conduct
It is prohibited to use the platform to:
- Submit false information, fraudulent reviews, or misleading ratings.
- Harass, threaten, or intimidate other users or Stowd staff.
- Attempt to bypass the platform to make direct arrangements to avoid fees.
- Access unauthorized areas of the platform or attempt to compromise its security.
- Reproduce, distribute, or commercially exploit platform content without authorization.
10. Intellectual Property
All content on the Stowd platform — including text, images, logos, interfaces, and source code — is the property of Stowd Technologies Inc. or its licensors, and is protected by applicable Canadian copyright and intellectual property laws. Operators grant us a non-exclusive licence to display their photos and information for the purpose of promoting their facility on the platform.
11. Disclaimer of Warranties
The Stowd platform is provided "as is" and "as available", without warranty of any kind, express or implied. Stowd does not warrant that:
- The platform will be available at all times without interruption.
- Information provided by operators is accurate or current.
- Listed facilities will meet your specific needs.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Stowd Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or property, arising from your use of or inability to use the platform, even if Stowd has been advised of the possibility of such damages. Stowd's total liability to you for any direct damages shall not exceed the amount you have paid to Stowd in the three months preceding the event giving rise to the claim.
13. Dispute Resolution
In the event of a dispute between a renter and a facility operator, both parties are encouraged to resolve it directly through the platform's messaging tools. Stowd may act as an informal mediator upon request but is not required to do so and assumes no liability in disputes between users.
Any dispute between you and Stowd shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec, Canada.
14. Changes to These Terms
Stowd may modify these terms at any time. For material changes, we will notify you by email or through a platform notification at least 14 days before the new terms take effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms.
15. Governing Law
These terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada, including Law 25 (formerly Bill 64) relating to the protection of personal information in the private sector in Quebec. These terms are provided in both French and English; in case of divergence, the French version prevails for users domiciled in Quebec.
